1. Acceptance of Terms
By downloading, installing, or using Finder ("the App"), provided by Datafruit LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
Finder AI is a mobile application that uses Artificial Intelligence (AI) to analyze user-uploaded photos and estimate their geographic location. The App functions as a pass-through interface to third-party AI models and does not store your images or personal data.
3. AI Disclaimer & No Warranties
PLEASE READ CAREFULLY:
AI Limitations: The location analysis provided by the App is generated by artificial intelligence (Gemini 3 Pro). AI models are probabilistic and can "hallucinate," meaning they may confidently provide incorrect, plausible-sounding, or entirely fabricated information.
No Guarantee of Accuracy: We do not guarantee that the locations identified by the App are accurate, current, or reliable. The App is for entertainment and informational purposes only.
Do Not Rely: You should not use this App for navigation, emergency situations, safety-critical tasks, or as the sole source of truth for identifying a location.
"As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
4. User Content & Conduct
Your Content: You retain all ownership rights to the photos you upload ("User Content").
License to Process: By uploading a photo, you grant Datafruit LLC and our third-party AI providers a temporary, worldwide, royalty-free license to process, analyze, and transmit the image solely for the purpose of providing the location service.
Prohibited Content: You agree not to upload images that are illegal, pornographic, harassing, threatening, or that infringe upon the intellectual property or privacy rights of others.
No Liability for Content: We do not monitor, store, or police User Content. You are solely responsible for the images you upload and the consequences of sharing them with the AI provider.
5. Subscriptions and Payments
RevenueCat: We use RevenueCat to manage subscriptions. By purchasing a subscription, you agree to the payment terms set forth by the Apple App Store.
Cancellations: Subscriptions are managed directly through your Apple ID settings. We do not process payments or refunds directly.
6. Limitation of Liability
To the fullest extent permitted by law:
Indirect Damages: Datafruit LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
Location Consequences: We are not liable for any actions you take based on the information provided by the App. (e.g., if the App incorrectly identifies a location and you travel there, we are not responsible for travel costs, safety, or lost time).
Liability Cap: In no event shall our total liability to you for all claims exceed the amount you have paid us in the last six (6) months, or fifty U.S. dollars ($50.00), whichever is greater.
7. Third-Party Services
The App utilizes the Google Gemini API for image analysis. Your use of the App is also subject to Google's terms regarding the use of their Generative AI tools. We are not responsible for service interruptions or errors caused by these third-party providers.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
